Sebenarnya, Hak Cipta (Copyrights) dan Hak Terkait (Neighbouring Rights) adalah bagian dari Hak Kekayaan Intelektual (HKI). Hak Cipta sendiri memiliki ruang lingkup yang paling luas karena meliputi seni dan sastra, ilmu pengetahuan, dan juga program komputer. Lagu merupakan salah satu bentuk karya cipta, didalamnya terdiri dari lirik dan nada. Apabila lagu tersebut diciptakan oleh seseorang, maka Hak Cipta melekat pada yang bersangkutan. Namun apabila lagu tersebut diciptakan oleh lebih dari satu orang, misalkan Pencipta lirik dan Pencipta nada merupakan orang yang berbeda, maka masing-masing pihak memiliki Hak Cipta terhadap masing-masing komposisi yang mereka ciptakan.
Apa Bukti Kepemilikan Hak Cipta?
Setiap pencipta akan diakui memiliki Hak Cipta apabila mereka dapat menunjukkan bukti bahwa dia adalah orang yang pertama kali mendeklarasikan karya cipta tersebut. Selain itu, pencipta juga dapat mendaftarkan karya ciptanya ke Direktorat Jenderal HKI. Melalui cara tersebut, Pencipta akan mendapatkan sertifikasi karya ciptanya. Berbicara soal lagu, sebenarnya setiap lagu bisa mendapatkan nomor registrasinya sendiri. Nomor registrasi ini berupa barisan nomor unik layaknya NIK pada KTP. Nomor registrasi yang biasa disebut dengan ISWC (International Standard Musical Work Code) bisa didapatkan melalui Publisher atau dengan mengunjungi official website dari ISWC. Bagaimana dengan Hak Terkait dalam Industri Musik?
Berbicara tentang Karya Rekaman atau konten yang dibuat dari komposisi Karya Cipta orang lain, maka diperlukan izin sebelumnya dari pemilik Hak Cipta (Pencipta Lagu) atau Kuasa Cipta (Publisher). Pada Undang-Undang Hak Cipta yang kita bahas di atas, dijelaskan bahwa izin tersebut umumnya diajukan oleh Produser atau yang secara hukum disebut Produser Fonogram. Siapa yang bisa disebut Produser? Seseorang atau pihak yang membiayai proses produksi dan sekaligus menjadi pemilik rekaman. Setiap Produser akan memiliki Hak Terkait yang melekat atas karya rekamannya. Tidak hanya Produser, Pelaku Pertunjukan atau Performer (penyanyi atau pemain musik) juga memiliki Hak Terkait dalam rekaman tersebut.
Apa Bukti Kepemilikan Hak Terkait?
Serupa dengan Karya Cipta, Karya Rekaman juga memiliki unique registration number di seluruh dunia, yang biasa disebut ISRC (International Standard Recording Code). Nomor ISRC ini bisa didapatkan dari asosiasi Label Rekaman di Indonesia seperti ASIRI (Asosiasi Industri Rekaman Indonesia) atau ASPRINDO (Asosiasi Produser Rekaman Indonesia) atau bisa melalui website isrc.com.

Adam adalah seorang Pencipta Lagu yang menciptakan sebuah lagu dengan judul “CINTA” dan didaftarkan dengan kode ISWC “T-123456789-Z”.
Nicko sebagai Produser Rekaman, meminta izin kepada Adam untuk memproduksi rekaman dengan lagu tersebut, dan setelah mendapatkan izin (peraturan izin HKI di Indonesia harus dilakukan di depan), karya rekaman tersebut diberi kode ISRC “ID-AAA-05-00001”.
Angga sebagai Produser Rekaman lain, juga meminta izin lagu yang sama kepada Adam untuk lagu yang sama, direkam dan diberi kode ISRC “ID-BAA-05-00005”.
Maka lagu dengan kode ISRC “ID-AAA-05-00001” dan ISRC “ID-BAA-05-00005”, memiliki klaim komposisi Hak Cipta yang sama yaitu dengan kode ISWC “T-123456789-Z”. Kesimpulannya, 1 ISWC (ciptaan) bisa menjadi banyak ISRC (rekaman).
